Terms and Conditions

(1) The following general terms and conditions apply to all legal transactions of smugo GmbH, Am Deimelberg 12, 54295 Trier (hereinafter referred to as the “Agency”) with its contractual partner (hereinafter referred to as the “Client”).

(2) Changes to these terms and conditions will be communicated to the Client in writing. They shall be deemed approved if the Client does not object in writing.

(1) The Agency provides services in the areas of web design, software development, online marketing and consulting. The precise designation and listing of the scope of services is set out in the respective offer.

(2) The Agency provides its services to the best of its knowledge and belief and in line with the current state of the art.

The Client undertakes to provide the Agency with all data and documents required to carry out the assignment in good time and in a suitable form. The Client warrants that it is entitled to use all materials provided to the Agency.

(1) Remuneration is agreed in accordance with the respective offer. All prices are exclusive of statutory value-added tax.

(2) Invoices are payable within 14 days of the invoice date without deduction.

(1) In cases of intent or gross negligence, the Agency shall be liable in accordance with the statutory provisions. Liability for guarantees applies regardless of fault.

(2) In the case of slight negligence, the Agency shall be liable exclusively under the provisions of the German Product Liability Act, for injury to life, body or health, or for the breach of essential contractual obligations.
